Hypothesis: The recent Executive Order is about increasing Employment based green cards at the cost of Family based green cards
As I was answering another poster about something, I realized what I was stating (that the EO was partly about gutting Family based immigration at the cost of employment based immigration) was not a conclusion reached by many observers yet. First, I am going to state some facts:
1) The vast majority of family based immigrant visas that are subject to quotas (i.e not Immediate Relative) are processed at consulates abroad.
2) The vast majority of employment based immigrant visas (all of which are subject to quotas) are processed as Adjustment of Status.
3) The recent Executive order by the president blocks immigrant visas processing at consulates abroad but does not impact Adjustment of status.
4) The immigration act of 1990 Section 101d states that any unused Family Based immigration visas are added to the employment based visas for the following year.
5) The president has previously expressed an interest in lowering family based immigration and increasing employment immigration.
Based on all of what I stated, I think part of the goal of the Executive Order is to achieve (5) above since Congress was not going to play ball. The EO also kills the diversity visas since the majority of those are also processed at consulates abroad.
