Hello, I am an US born citizen. My wife is from South Korea and recently graduated from nursing school by being in the US for years on a student visa (I think OPT). We met in December and married early this month (April). We are wanting to apply for AOS and EAD for her. She is still located in the US on a valid visa. She has done some unauthorized work in the past.
My understanding is that these bars are forgiven by the USCIS if the person applying has an immediate relative. We are planning to admit to the unauthorized employment.
While it may be true that unauthorized employment with an immediate relative is forgiven, it is still consider illegal. Could there be any other consequences from the unauthorized employment even though she has an immediate relative?
Could it appear on background checks when applying for jobs (nursing position)? Would this cause extra barriers when we plan to travel in the future to other countries? Would this void her education she earned with her student visa? Should we get an immigration lawyer just in case?
I know it will be difficult to give a confident answer as anything can change with the current world situation and government.
