I am planning on studying at WPI this fall. I am from Argentina, and the obvious route to living in the US would be to apply for a student visa.
My dad, however, is filing for an O visa promptly, alongside my family. I am 18 years old and unmarried, so I am his dependent.
My initial thought was to apply to both, see which arrives first, and go with that. However, I don’t know if there is dual intent in this case. My first question, then, is: can I apply for a student visa and an O visa simultaneously?
Let’s say the answer is no. I would probably apply for a student visa: they take much shorter to go through and there is much less of a chance of rejection. The O visa has the opportunity to apply for a Green Card immediately, so this is what my family plans on doing. Question number two is, could I apply for the Green Card as their dependent, given that I have a student visa and not an O dependent visa?
Really need this advice! Legal professionals have given us differing opinions...
