What to do when a mortgage lender won't accept USCIS documents as proof of permanent residency?

Hello all,

As the title suggests, I have applied for a mortgage, we were preapproved, are under contract, we paid the lender for the appraisal etc.

My conditional permanent resident card has an expiration date of early November 2020. I applied for removal of conditions in a timely manner, the application was accepted and my I-797 notice clearly states that my residency is extended by 18 months and that, when presented with my expired Green Card, it is proof of residency and work authorization. My spouse is also a US citizen.

The problem is that the lender is not accepting the I-797 as proof of residency, even though it clearly states so on the official USCIS letterhead. They want an I-551 stamp. Unfortunately, USCIS is not holding any infopass appointments right now. They don't even want to take my biometrics (fingerprints) and sent me a notice that they'd just use my old ones. Usually, a biometrics appointment is when they apply the I-551 stamp (as far as I know).

I have called USCIS several times. Each time I was told that no matter how emergent my situation currently is, there is no way that they will schedule me for an I-551 or ADIT stamp on my passport since my permanent resident status doesn't expire until 18 months from now (as clearly stated on the I-797). I can only get that stamp within 30 days of expiry. I have conveyed this to my lender but they're not budging.

I have a significantly higher income than my spouse, so I don't think we can have her as the sole applicant.

  1. Do I have any recourse here?
  2. Is it even worth talking to HUD about this?
  3. Assuming sunk costs, do you know of any lenders who are more up to date with current immigration laws and practices?

Thank you all, this is a very stressful time for us as our lease is about to be up and we don't want to be left homeless.

NVC Case FE Review note

Hi everyone, my family and I are under the F3 category and we just received a notice from NVC that our documents have been approved and that we are Documentarily Qualified. My only concern is this message that we received today in addition to the acceptance: " [Name of petitioner] does not meet the minimum income requirement to sponsor the intending immigrants for this case. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p . To avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor may be submitted." We already have a petitioner and a household sponsor (the household sponsor's income is above the required level), but still unsure why we received this. Has anyone else received this message? All of our documents say "Approved" on NVC. Does this mean we have to find another sponsor? Can we show the consular officer our ...
