Marrying a Thai national this weekend....

I am pretty familiar with the process as friends have been through this several times....but just reaching out for advice.

  • She is here on a legal B1/B2 visa expires Dec of 2021. Clean immigration history. She got the 10 year visa in 2019. She has been in the US for over 60 days.
  • She is not working at this time, but has a great work history in Thailand. Has a house paid for in Thailand, and a vehicle. No other assets.
  • She needs a SS number.
  • I am a US citizen.
  • We have been together 3.5 years. I was going to move/retire to Bangkok and lived there for a while prior to covid (live unmarried). With all the travel restriction on Covid we changed plans and here we are.
  • Have a prenup which we signed last month.
  • I have not started gathering documents, but looks like I need to make a book of our history.

Once we marry and have the Marriage certificate.....what is the next step? Besides hiring an immigration lawyer to guide us what should we be doing/documenting.

NVC Case FE Review note

Hi everyone, my family and I are under the F3 category and we just received a notice from NVC that our documents have been approved and that we are Documentarily Qualified. My only concern is this message that we received today in addition to the acceptance: ​ " [Name of petitioner] does not meet the minimum income requirement to sponsor the intending immigrants for this case. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p . To avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor may be submitted." ​ We already have a petitioner and a household sponsor (the household sponsor's income is above the required level), but still unsure why we received this.
