I’m in the process of marrying my American fiancé and I currently live outside the U.S. (while he lives inside it). I have two options: K1 fiancé visa where I marry in America, and an immigrant visa that I can obtain after marrying him outside the United States.
I had a lawyer tell me that k1 presents me with more scrutiny to my relationship and I have a bigger burden of proving the “Bona fide ” aspect. She recommends I marry and then apply for a marriage based green card, and says these visas are prioritized over k1 (because currently there are processing backlogs). Any thoughts? Has anyone been recommended a similar path?
